Terms of Use

1. Agreement

These Terms of Use (“Terms”) are a legal agreement between you (“you”, “guest”, “user”) and Smartlink Solutions (“Smartlink”, “we”, “us”, “our”). By accessing or using our Services — including scanning a table code, viewing a live bill, placing an order, or paying digitally — you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. What Smartlink does (and does not do)

We provide technology that lets you view the restaurant’s menu, send requests (order items / call waiter / ask for bill), see your running bill, split or settle a bill, and pay digitally.

We are not the restaurant. The restaurant or venue is solely responsible for menu accuracy, item availability, pricing, taxes, service charges, food safety and quality, fulfilling your order, and handling your table/check in their POS system.

We are not a bank or payment institution. Payments are processed by licensed payment providers. We act as a technical bridge between you, the venue, and the processor.

4. Pricing, fees, tips, and service charges

Prices, taxes, VAT, and service charges are provided by the venue and/or required by law. Some venues may apply an additional service or platform fee for digital ordering and payment; when it applies, we show it before payment. Tips are optional and set by you. The final “Total to Pay” shown before you press “Pay” is the amount that will be charged (in local currency unless otherwise stated).

5. Payment and settlement

Pressing “Pay” authorizes the processor to charge your payment method, and allows us to notify the venue and treat the amount as settled. If you partially pay, there may be a remaining balance. Disputes about the bill should be raised with the venue; we can provide transaction references but do not control the POS.

6. Refunds and chargebacks

Refunds or adjustments are handled by the venue and/or the payment processor per their policies. We cannot guarantee refunds and may not refund fees or tips unless required by law. Chargebacks may be disputed with order/payment evidence.

7. Service availability

We may suspend or limit access for maintenance, upgrades, fraud checks, or technical reasons. We do not guarantee availability on all devices or locations, and we are not responsible for network outages, POS failures, processor downtime, or device/browser issues.

8. Acceptable use

No hacking, reverse-engineering, or disrupting the Service; no harassment of staff; no unauthorized payment methods; no bypassing payment. Abuse may lead to suspension.

9. Ownership and license

All software, interfaces, visuals, text, branding, and materials are owned by Smartlink or licensors. You are granted a limited, non-exclusive, non-transferable, revocable right to use the Services for personal, lawful use at the venue you’re in. You may not copy or resell the Services.

10. Limitation of liability

To the maximum extent permitted by law, Smartlink will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability to you for any claim related to the Services will not exceed the fees (excluding food/drink cost) you paid through the Service for that specific transaction. Food quality/allergens/preparation/delivery are the venue’s responsibility.

11. Privacy

Your use of the Services is governed by our Privacy Policy.

12. Termination / Suspension

We may suspend or terminate your access at any time without notice if we believe you violated these Terms, attempted fraud/misuse, or if continuing service creates legal/compliance/security risk. Sections that should survive termination (Payments, Refunds/chargebacks, Limitation of liability, Governing law) continue to apply.

13. Governing law

Unless a local mandatory law says otherwise, these Terms are governed by the laws of the United Arab Emirates, with disputes handled in competent UAE courts.

14. Changes to these Terms

We may update these Terms. Material changes will update the “Last updated” date. Continued use means acceptance.
